The court marriage, under section 12 can be solemnised at the office of the Marriage Officer, or at such other place within a reasonable distance.

The marriage shall be binding only when each party in the presence of the Marriage Officer and the three witnesses says to the other party in any language understood by the parties “I, (A), take thee (B), to be my lawful wife (or husband)”. The parties may choose to solemnise their marriage in any form.

  • A person should not have a subsisting marriage with any other person on the date of court marriage.
  • The woman should not be less than 18 years old and the man not less than 21 years old on the date of marriage.
  • Both of them should be of sound mind and be able to give their valid consent to marriage.
  • Both of them should not fall within the degree of prohibited relationship unless provided for by the custom governing them.
  • The Certificate of Marriage: Once the declaration is signed, the Marriage Registrar enters the certificate in the Marriage Certificate Register. This certificate becomes the conclusive proof of the marriage.
